Terms of Service

1. Acceptance of these terms

These Terms of Service govern your use of the TrustWays AI website (trustways.ai) and the TrustWays AI platform. By creating an account, accessing the platform, or submitting a demo request, you agree to be bound by these terms. If you don't agree, don't use the service.

For enterprise customers we sign a Master Subscription Agreement (MSA) which supersedes these terms. These terms apply to free trials, self-service signups, and website visitors.

2. The service

TrustWays AI is a multi-framework compliance platform that lets organisations discover, classify, document, and monitor their AI systems against regulatory frameworks (EU AI Act, ISO 42001, GDPR, UK GDPR, CCPA, FADP, DPDP, RBI FREE-AI, SEBI AI/ML — see /frameworks for the full list).

We work hard to keep the service available 24x7 but we don't warrant uninterrupted operation. Enterprise SLAs are negotiated separately.

3. Accounts + access

You're responsible for all activity under your account. Keep your credentials confidential. Enable MFA. Notify us immediately of any unauthorised access.

We don't create accounts on your behalf. SSO / SAML / SCIM is supported for Growth + Enterprise tiers.

4. Customer data ownership

You own your customer data. We don't claim any rights over the AI systems, classifications, documents, risks, gaps, or any other content you store in the platform. We use customer data only to provide the service, secure it, and respond to your support requests.

We do not train AI models on customer data. Counsel (our regulator-aware AI assistant) sends your prompts to Anthropic's API per our subprocessor terms, but the prompts are not retained for model training under our agreement with Anthropic.

5. Your obligations

You agree to:

  • Use the platform in compliance with applicable law.
  • Provide accurate registration data.
  • Not use the platform to process illegal content.
  • Not reverse-engineer, copy, or resell the platform.
  • Pay all fees on time.

6. Acceptable use

The following are prohibited:

  • Attacking or attempting to gain unauthorised access to the platform or other tenants' data.
  • Uploading malware, viruses, or other malicious code.
  • Scraping the platform or building competing services using our content.
  • Abusing rate limits, API quotas, or fair-use thresholds.
  • Using the platform to generate misleading regulatory representations or to facilitate fraud against regulators.

7. Fees + billing

Subscription fees are described in your order form or, for self-service tiers, on the pricing page (request a quote for current pricing). Fees are billed annually in advance for Enterprise unless otherwise agreed, or monthly in advance for self-service tiers. All fees are non-refundable except as required by applicable law.

Trial accounts are free. We don't ask for payment details to start a trial. We ask for them when you're ready to subscribe.

8. Term + termination

The subscription term is stated in your order form. Either party may terminate for material breach if the breach is not cured within 30 days of written notice.

We may suspend your account immediately for security threats, non-payment after warning, or acceptable-use violations. On termination we delete your customer data 90 days after the effective termination date, unless legal retention obligations (e.g. SEBI 5-year AI/ML log retention) require longer.

9. Intellectual property

The TrustWays AI platform, including the control catalogs, cross-mappings, regulator preambles, and document templates, is our intellectual property. The underlying regulatory texts (EU AI Act, GDPR, etc.) are the property of their respective regulators / governments and we attribute them where required.

You retain ownership of your customer data and any documents you create using the platform.

10. Warranties + disclaimers

We warrant that the service will perform substantially as described in our published documentation. We don't warrant that the service is error-free, that it will meet your specific compliance needs, or that documents generated by the platform will be accepted by your regulator without further work.

The platform is not a substitute for legal advice. Documents generated by Counsel and the platform's framework artefacts must be reviewed by qualified legal and compliance professionals before submission to any regulator.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to these terms is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages.

Nothing in these terms limits liability for death, personal injury, fraud, or any liability that cannot be excluded under applicable law.

12. Indemnity

You agree to defend, indemnify, and hold harmless TrustWays AI from any claim arising out of your misuse of the service, your violation of these terms, your breach of applicable law, or your infringement of third-party rights.

13. Governing law + jurisdiction

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India, except where mandatory consumer-protection law gives you a right to sue in your country of residence.

14. Changes to these terms

We update these terms from time to time. Material changes are notified by email to active customer admins at least 30 days before they take effect. If you don't agree to the new terms, you may terminate before they take effect.
